The bill to repeal the state law banning adultery was approved by legislators. A lobbyist outside the Senate chamber said that the current law that punishes adultery with up to 90 days in prison or a $500 fine was written in 1907. adultery is illegal in New York according to a law over 100 years old.

Assemblymember Charles D. Lavine sponsored the repeal of adultery in the legislature.

It was an outdated law that wasn't practiced in New York state so we're updating it whenever we can. The state Assembly passed the measure last month, meaning it needs the approval of Hochul before it can take effect.
